Privacy Collection Statement

Your personal information is being collected by Wyndham City Council for the purpose of administering your application for the Penrose Promenade Community Centre Mural Project.  Any information you submit as part of your application will be processed by Council in accordance with the project Terms and Conditions.  Your personal information will be stored in Council’s Customer Database and used to identify you when communicating with Council and for the delivery of services and information.  You can access or amend your personal information at any time by writing to mail@wyndham.vic.gov.au.  Your personal information will be handled in accordance with the Privacy and Data Protection Act 2014 (Vic).For further information on how your personal information is handled, visit Council’s Privacy Policy.

Declaration and acknowledgement

By submitting an expression of interest (‘EOI’) to be selected as the artist to design or design and install a mural at Penrose Promenade Community Centre (‘project’), you agree to be bound by these terms and conditions.

These terms and conditions should be read in conjunction with other documents and information relating to the project, including your EOI form, the artist brief, and the information made available on Council’s website.

  1. ELIGIBILITY

    To be eligible to submit an EOI, you must be an artist aged 18 years or above and live or work in or otherwise have a connection to Wyndham.  Council staff, Councillors and their immediate family members are ineligible to apply.

  1. EXPRESSIONS OF INTEREST

    2.1 EOIs must be submitted between 5:00pm on 18 October 2024 and 5:00pm on 11 November 2024 via Council’s website.  EOIs which are incomplete or received outside of this period will not be accepted.

    2.2 You agree to immediately notify Council of any changes to your EOI, including the request to withdraw your EOI by emailing yi.li@wyndham.vic.gov.au.

    2.3 Council accepts no responsibility for late, lost, incomplete, invalid or corrupt EOIs.

  1. ASSESSMENT OF EXPRESSIONS OF INTEREST

    3.1 EOIs will be assessed by Council officers on 12 November 2024 in accordance with the evaluation criteria published on Council’s website.  Up to three applicants will be shortlisted and invited to prepare an initial concept proposal to Council.

    3.2 Shortlisted applicants will be contacted by Council by 5:00pm on 13 November 2024 and required to submit their initial concept proposal no later than 5:00pm on 26 November 2024.  Subject to submitting a valid tax invoice to Council, shortlisted applicants will be paid $500 (excl. GST) for preparing this proposal.

    3.3 On 27 November 2024, Council officers will select one applicant from those shortlisted as the successful applicant to participate in the project.  The successful applicant will be contacted by 5:00pm on28 November 2024.  

  1. SUCCESSFUL APPLICANT

    The successful applicant will be engaged by Council to participate in the project, including leading a community engagement workshop to develop the final design for the mural, and will be required to enter into an agreement with Council and comply with its terms and conditions.

  1. NO RELATIONSHIP

    Nothing in these terms and conditions or in the conduct of Council and you creates a relationship of agency, partnership, employer and employee or joint venture between you and Council.

  1. GENERAL

    6.1 Council reserves the right to change or modify these terms and conditions at any time and without notice to you.

    6.2 Council’s decisions are final and no correspondence will be entered into.
