As specified in the Road Management Act 2004 and the Fences Amendment Act 2014, Wyndham City is not obliged to make a financial contribution to a property owner, for the repair or replacement of a fence that adjoins Council managed land.
Wyndham City will however provide a financial contribution for the repair or replacement of a fence in certain circumstances, and for an amount at its discretion.
Acceptable circumstances include:
- A fence adjoining a Wyndham City recreation reserve.
- A fence adjoining a Wyndham City wetland.
- A fence adjoining a Wyndham City community centre.
- A fence adjoining a Wyndham City kindergarten.
A contribution is not applicable for the following circumstances:
- Where a fence adjoins a roadway or nature strip.
- Where a fence adjoins a Wyndham City garden or tree reserve (eg. A section between a property boundary and a main roadway not used for recreational purposes).
Wyndham City’s contribution amount will be based on the average market rates for the replacement of a standard 1.95m timber paling fence. Contributions will only be paid directly to the fencing contractor once Wyndham City has inspected the completed fence and is satisfied with the works.
To apply for a fencing contribution, you are required to download and complete the Application for a Fencing Contribution form and submit it, along with two written quotations for the work. Wyndham City must approve the work and confirm our contribution amount before the fencing contractor is engaged. Contribution applications will not be considered if the work has already been undertaken and no prior notice was provided to Wyndham City.
