If you would like to close part or the entire footpath or nature strip or part of a Council Road, you need to download, complete and submit an application for a Permit to Occupy for Works.
If your application is relation to construction works that require a Building Permit, you must attach to your application either:
- a copy of an approved Report and Consent: Protection of the Public under regulation 116 of the Building Regulations 2018; OR
- a letter from your registered Building Surveyor stating that you do not require Report and Consent under regulation 116 of the Building Regulations 2018.
No applications to Occupy Space for construction under Council’s Local Law will be accepted unless one of the above documents is attached.
Your Building Surveyor will determine whether you need to apply for Report and Consent: Protection of the Public under regulation 116 of the Building Regulations 2018. For further information about the application process, you can contact Council’s Building Department on 9742 0994.
All applications must also include a copy of your Public Liability Insurance and a Pedestrian Management Plan. The Pedestrian Management Plan must include the area set aside for pedestrian use, or alternative routes, location of any taped areas, bollards or similar, and/or any other relevant information to clearly show how pedestrian access will continue during the works.
Where an application includes a request for a road to be closed in full or in part, Council’s Traffic Engineers must approve a Traffic Management Plan.
