Holiday Action Program Terms and Conditions
These terms and conditions apply to the Holiday Action Program (‘program’) run by Wyndham City Council (‘Council’).
By registering the young person to participate in an activity/ies as part of the program, you agree to be bound by these terms and conditions.
These terms and conditions should be read in conjunction with any relevant program information – e.g. the young person’s program registration form, any information about the program available on Council’s website and any correspondence from Council regarding the program.
1. ELIGIBILITY
To be eligible to participate in the program, the young person must be aged between 12 and 17 years of age and live, work, study or socialise in Wyndham.
2. REGISTRATION AND PAYMENT
2.1. To register to participate in the program, the parent or legal guardian of the young person must submit a properly completed registration form and pay the registration fees via Trybooking between 9:00am on 17 March 2025 and 9:00am on 9 April 2025.
2.2. Registrations for each program activity will be accepted on a ‘first come first served’ basis. Once registrations have been exhausted, you will be added to a waiting list and may be contacted if a place in a program activity becomes available.
2.3. Where the young person is a concession card holder, a discounted registration fee will apply. Evidence of the young person’s concession card must be provided to Council on request. If such evidence cannot be provided, the full registration fee must be paid.
3. PROGRAM PARTICIPATION
3.1. The young person must be at Council’s Youth Resource Centre (86 Derrimut Road, Hoppers Crossing) at the time the program activity starts. Where the activity is an offsite activity (e.g. an excursion), Council will not wait for any latecomers before departing.
3.2. You agree to complete any additional paperwork or documentation that may be required to facilitate the young person’s participation in the program. You acknowledge and agree that if such paperwork or documentation is not completed and returned to Council, the young person will not be permitted to participate in the activity.
3.3. If the young person is not permitted to leave the program by themselves, they must be collected at the conclusion of the activity by the authorised person(s) specified in their registration form. You acknowledge and agree that if the young person is not collected within 15 minutes of the conclusion of the activity, Council will not be responsible for supervising the young person and may notify Victoria Police.
4. MEDICAL
4.1. You confirm that the young person’s emergency contacts have been notified and have consented to their personal information being provided to Council.
4.2. If the young person becomes ill or suffers an injury during the program and the emergency contacts cannot be contacted, you consent to the young person receiving first aid and emergency medical treatment (including transport to hospital by ambulance) as may be deemed necessary by Council. You agree that you are entirely responsible for the costs of such emergency medical treatment.
5. EXPECTED BEHAVIOUR
5.1. At all times during the program, the young person must be respectful, follow all reasonable directions of Council staff and activity facilitators, and conduct themselves in a manner that upholds Council’s values and reflects prevailing community standards.
5.2. If the young person does not comply with condition 5.1 or otherwise misbehaves during the program, Council may require the young person to be collected from the activity by their parent or legal guardian or emergency contact or may otherwise send the young person home from the activity at your expense.
6. LIABILITY
6.1. You acknowledge and agree that the young person participates in the program at their own risk.
6.2. To the extent permitted by law, Council is not liable to you or the young person for any loss, damage, claim or expense (‘loss’) suffered, including but not limited to property loss or damage, personal injury and death, as a result of or in connection with the young person’s participation in this program, except to the extent that any such loss is caused or contributed to by the negligent act or omission of Council.
7. PROGRAM WITHDRAWAL, MODIFICATION AND CANCELLATION
7.1. You may withdraw the young person from the program at any time by emailing holidayactionenquiries@wyndham.vic.gov.au.
7.2. Council reserves the right to end a young person’s participation in the program where Council reasonably believes that these terms and conditions have been breached or that the young person’s registration form contains false, inaccurate or misleading information.
7.3. You acknowledge that Council may modify a program activity in circumstances where the activity is no longer available or inclement weather.
7.4. Notwithstanding any other provision of these conditions, Council expressly reserves the right to cancel the program at any time.
7.5. Council may amend these terms and conditions at any time and without notice to you.
