Privacy Collection Statement

Your and your child’s personal information is being collected by Council to enable your child to enter the Kids Photography Competition and will be used in the administration of the competition as stated in the Kids Photography Competition Terms and Conditions.  Your and your child’s information will be stored in Council’s Customer Database and used to identify you/your child when communicating with Council and for the delivery of services and information.  By providing your and your child’s details, you consent to the collection, use and disclosure of this personal information as stated in the Kids Photography Terms and Conditions. Your personal information will be handled in accordance with the Privacy and Data Protection Act 2014 (Vic).  For further information on how your personal information is handled, visit Council’s Privacy Policy

Declaration
  1. This competition is run by Wyndham City Council (‘Council’) in the state of Victoria, Australia only.
     
  2. By submitting your child’s entry into this competition, you:

         a) confirm that you are the entrant’s parent or legal guardian (‘parent’);

         b) consent to your child entering this competition; and

         c) accept these terms and conditions of entry.

  1. Entries which do not comply with these terms and conditions will not be valid and will not be accepted.
     
  2. Entrants must be aged between 5 and 12 and must live, study or socialise in Wyndham.  Council staff, Councillors and their immediate family members are not eligible to enter.
     
  3. To enter the competition, you must submit a properly completed entry form and upload a copy of your child’s photograph via Council’s website between 12.01am on 3 December 2024 and 11.59pm on 31 January 2025.  Entries received outside of this period will not be accepted.
     
  4. Entries must be your child’s own original work, and must not contain any offensive or inappropriate material, or infringe a third party’s intellectual property rights.
     
  5. Where a person is capable of being identified in your child’s photograph, you must obtain that person’s consent (or their parent/guardian’s consent if they are under 18) to be photographed and for that photograph to be entered into the competition.  Evidence of such consent must be provided to Council on request.
     
  6. One entry per entrant will be accepted.
     
  7. The competition will be judged by Council officers by 15 February 2025 in accordance with the following judging criteria: originality, skill, uniqueness and adherence to the competition theme.  Two winners will be chosen: one winner from all entries in the 5-8 age group and one winner from all entries in the 9-12 age group.  Each winner will receive a Fujifilm Instax Mini 12 Instant Photographer Kit in pastel blue, valued at $139 each.  The total prize pool is valued at $278.
     
  8. Winners’ parents will be contacted via email no later than 5:00pm on 21 February 2025.  Winners will subsequently be announced on Council’s website and the Libraries in Wyndham Facebook page on 28 February 2025.  Winners’ parents consent to the publication of their child’s name in connection with this announcement.
     
  9. If a winner’s parent cannot be contacted by 5:00pm on 26 February 2025, Council may opt to conduct further judging to determine a new winner.
     
  10. If a prize has not been claimed by 6.00pm on 7 March 2025 the winner will be deemed to have surrendered the prize and Council may opt to conduct further judging to award the unclaimed prize.
     
  11. Council may, on claiming of their prize, require the winner or their parent to provide evidence of their identity and/or that the winner lives, studies or socialises in Wyndham.
     
  12. You acknowledge that your child retains copyright in their entry.
     
  13. You grant Council a perpetual, irrevocable and royalty-free licence to publish, cause to be published or otherwise use your child’s entry (in whole or in part) in:

             a) posts on the Libraries in Wyndham Facebook page;

             b) an online gallery on Council’s website; and

             c) displays at any of the Wyndham Library Service branches, for the purpose of promoting the competition.

  14. You acknowledge that your child’s name and age as provided in their entry form may be published in connection with the publication and/or use of their photograph.
     
  15. You acknowledge that upon publication of your child’s entry online, it will become capable of being shared, saved, downloaded or otherwise distributed by the public.  You agree that Council accepts no responsibility or liability for the way that members of the public use, share, save, download or otherwise distribute your child’s entry once it has been published online.
     
  16. You indemnify and hold harmless Council, its councillors and employees against all costs, claims and liability arising in connection with a breach or potential breach of these terms and conditions.
     
  17. Prizes are not transferable, exchangeable or redeemable for cash.
     
  18. Council accepts no responsibility for late, lost, incomplete, invalid or corrupt entries.
     
  19. If for any reason the competition cannot be run as planned, Council reserves the right to cancel, terminate, modify or suspend the competition.
     
  20. Council reserves the right to amend these terms and conditions at any time without notice.
     
  21. Council’s decisions are final and no correspondence will be entered into.
