Why is Council installing Electric Vehicle (EV) chargers?

Electrifying our transport sector is critical to reducing greenhouse gas emissions and mitigating climate change. Council is installing public EV chargers across various facilities to enable Council’s fleet transition and support community uptake of EVs through provision of public chargers.

Benefits of Electric Vehicles

EVs offer both environmental, health and economic benefits. To drivers, they can bring cost savings through lower fuel and maintenance costs. They also contribute to cleaner air, quieter streets, and long-term energy efficiency. All council’s EV chargers are powered by 100% renewable electricity, supporting the transition to clean energy.

Using Council EV Chargers

Where and what type of charger do Council have?

There are different levels of EV charging infrastructure which provide charging at different rates and speeds (e.g., slow or fast chargers). Council chargers’ range in capacity from standard 22kW AC chargers (approximately 1h charge per 100km range) to 80kW DC fast chargers (approximately 15min charge per 100km range).

How do you use Council’s EV chargers?

EV chargers are relatively simple to use – you connect a cable from the charging station to the electric vehicle via a power cable and plug. Depending on the charging station, some will have cables attached to the charger (tethered) while for others, drivers must bring their own cable to charge.

Council currently subscribes to both the Chargefox EV charger network and the Exploren EV Charger network and software portals to manage charging sessions. For ease of use, you can download the Chargefox app or the Exploren app to set up an account. Once you have an account, you can activate the charging session once the vehicle is physically plugged in through the relevant app for that charger.

It is also possible to use Council’s chargers via contactless RFID payment systems, such as credit cards and smartphone apps. Each of Council’s chargers are equipped with an RFID payment terminal and the chargers can be activated by simply tapping or waving the card near the card reader.

Does it cost anything to use Council’s EV chargers?

Yes, to manage the costs associated with operating and maintaining these chargers, and to create conditions that encourage private operators to add to our EV charging network, Council introduced fees for charging from 1 December 2023. The following fee structure is currently adopted:

  • $0.25 / kWh for all chargers up to 22kW (slow and destination chargers)
  • $0.45 / kWh for all 50kW chargers and faster (fast chargers)

If there is an issue with the EV charger what happens?

Council have partnered with both Chargefox and Exploren to maintain Council’s EV chargers. Customer support contact details are either located on the front of the EV chargers or can easily be found within the relevant charging app on your mobile phone.

Alternatively, each provider is available to provide assistance to users if they experience problems with charging whilst on site and can be contacted directly on the following support numbers.  The EV Charger Station ID number found on the front of each charger will be required once phone support is requested.

Future EV chargers

To improve network coverage, Council will be installing further EV chargers through the Wyn-R (Reduction, Renewables, Resilience) capital works program.

Terms and Conditions

Terms and Conditions for Public Users of Wyndham City Council Electric Vehicle Chargers

Definitions:

(a) WCC Refers to Wyndham City Council

(b) EV means a motor vehicle that is legally registered for use on public roads which is wholly or partly propelled by an electric energy source stored in one or more on-board rechargeable batteries that can be plugged-in to charge using electricity supplied by an EV Charging Station and, where the context requires, includes any passenger or any personal property in or around the motor vehicle.

(c) EV Charging Station means stationary infrastructure that provides electric energy for the recharging of an EV, including alternating current (AC) and direct current (DC) chargers or super-fast chargers, and all its components, including charging cables. 

(d) Public EV Charging Station mean any EV Charging Station owned and operated by WCC which is not a WCC fleet EV Charging Station.

(e) Terms means these terms and conditions as amended, supplemented or replaced by WCC from time to time.

(f) Public EV Charging Network means the collection of EV chargers that are available for public use and may be owned and or operated by public or private entities.

(g) WCC Policies means any policies and procedures as amended, supplemented or replaced by WCC from time to time.

(h) WCC EV Charging Station means any EV Charging Station owned and operated by WCC located on any WCC sites in a parking bay marked with hatching and “Electric Vehicle Charging Only” and/or signage indicating that a charger is restricted to WCC staff usage only.

(i) User Data means any information relating to you, including personal information and data relating to a vehicle.

(j) you means any person who connects an EV to the WCC Public EV Charging Network (and your has a corresponding meaning).

1. Acceptance of Terms: By using the electric vehicle (EV) chargers provided by Wyndham City Council (referred to as "we" or "us"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the EV chargers.

2. Use of EV Chargers: The EV chargers are provided for the purpose of charging electric vehicles only. Any other use is strictly prohibited.

2.1 Prohibited Actions include:

(a) parking a non-EV, in a designated parking bay marked “Electric Vehicle Charging Only” or ‘Council EV Only’ (or words to that effect);

(b) charge an EV from a bay adjacent to designated EV charging bays, even if this is physically possible; and

(c) engaging in any activity or behaviour that may:

(i) cause loss or damage to the Public EV Charging Station; or

(ii) be detrimental to the interest of WCC or the WCC Public EV Charging Network.

2.2 WCC retains the right to deny entry or usage to a Public EV Charging Station to any vehicle or individual at its discretion.

2.3 Access to and use of Public EV Charging Stations:

(a) is governed by the relevant time limit for each particular Public EV Charging Station; and

(b) incurs parking fees or necessitates parking permits as indicated by applicable signage.

(c) is subject to fees as outlined in section 4.

3. Registration and Access: To use the EV chargers, you may register for an account with any third party software provider that is in use at a Public EV charging station. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Third party providers may require User Data. Any data help by a third party provider is subject to the Privacy Policy of the third party and is not the responsibility of WCC. Any data held by WCC will be subject to the WCC Privacy Policy.

4. Fees for use: Fees will be assigned in accordance with WCC Policies. Fees will be clearly displayed at the charging station or through the associated mobile application. By using the EV chargers, you agree to pay any applicable fees. Fees are to be reviewed annually and WCC reserve the right to amend fees as required. Fees may vary depending on charger speed/capacity, or during a charge session based on duration of charge or hours of use.

If you believe you have been charged incorrectly, it is your responsibility to contact the third party software provider responsible for fee handling to resolve the issue. In the instance that the issue cannot be resolved you may raise the issue to WCC for review. In the instance an error has occurred, you will be refunded by the responsible party, third party provider or WCC.

WCC will not refund fees or pay for compensation for scenarios not guaranteed under section 8 Availability of Service.

5. User Conduct: You agree to use the EV chargers in a responsible and safe manner. Any abusive, unlawful, or fraudulent use of the chargers is strictly prohibited.

6. Safety Guidelines: Users must follow all safety guidelines provided by WCC either at the charging station or detailed on the WCC website and as required by your EV manufacturer. Users must act according to the responsibilities and prohibitions detailed in section 6.1 and 6.2.

6.1 Your responsibilities include:

(a) avoiding driving over, parking on, or causing any damage to any charging cable left on the floor or ground;

(b) verifying that the Public EV Charging Station is operational and ensuring there is no visible damage that may impact performance;

(c) confirming compatibility between your EV and the Public EV Charging Station’s plug type before use;

(d) Ensuring the cable is closely aligned with your EV and within the assigned parking bay after initiating your charging session, to prevent any safety hazards;

(e) returning the cable to its holder or if not possible, securing it around the Public EV Charging Station after completing your charging, to prevent any safety hazard or damage from other motor vehicles;

(f) adhering to any signs and other written instructions on, within, or near Public EV Charging Stations.

6.2 Prohibited actions include:

(a) overstretching of charging cable in order to prevent damage to your EV and/or the Public EV Charging Station;

(b) interrupting another user’s EV charging session, or interfering with a Public EV Charging Station (including the cable) in use by another user;

(c) using a Public EV Charging Station in a manner that may cause or result in any:

(i) loss or damage to any EV or other motor vehicle; or

(ii) loss or damage to any item, in or upon any EV or other motor vehicle; or

(iii) injury to or death of any person;

(d) any action that could void or otherwise prejudice insurance coverage (or similar protection)

(e) using, or attempt to use, the Public EV Charging Station if it is not compatible with your EV;

7. Reporting Issues: Users are responsible for reporting any issues, malfunctions, or damage to the EV chargers immediately through the provided contact information. If you suspect issues or damage to the EV charger you must not use the EV Charging Station.

8. Availability of Service: We strive to provide a reliable service, but we do not guarantee the availability of the EV chargers at all times. We are not responsible for any inconvenience or damages resulting from service interruptions. WCC make no guarantee to;

(a) the suitability, correctness or reliability of any EV Charging service supplied by WCC;

(b) the availability or compatibility with your EV, or performance of any Public EV Charging Station;

(c) your ability to connect your EV to a Public EV Charging Station to obtain a successful and timely recharge of your EV; or

(d) an uninterrupted supply of electricity Public EV Charging Stations.

9. Liability: We are not liable for any damage to your vehicle or any loss or injury arising from the use of the EV chargers, except where such damage, loss, or injury is caused by our negligence.

9.1 You assume all risks associated with the use and operation of:

(a) a Public EV Charging Station; and

(b) any adaptor or other equipment in connection with a Public EV Charging Station.

9.2 To the extent permitted by law, WCC holds no liability to you or any other person for:

(a) any incompatibility of a Public EV Charging Station with your EV;

(b) any disruption or interruption to the WCC Public EV Charging Network caused by:

(i) incompatibility with your motor vehicle including an inability to charge or mobilise your motor vehicle;

(ii) the actions or conduct of other users; and

(iii) the enforcement of parking restrictions by law enforcement officials including any fines issued while using a Public EV Charging Station.

(c) theft, loss or damage to any:

(i) EV or other motor vehicle; and

(ii) item in or upon any EV or other motor vehicle;

(d) injury to or death of any person, regardless of how such loss, damage, injury or death may arise; or

(e) temporary restriction of access to or use of a Public EV Charging Station for repair and maintenance or a reason outside the control of WCC.

9.3 You agree to indemnify WCC against all claims, actions, costs, loss and damage, expenses, and liability which WCC sustains or incurs as a result of, or in connection with:

(a) your access to, operation of, use or misuse of a Public EV Charging Station;

(b) any negligent or reckless act or omission by you; or

(c) any breach of these Terms by you.

10. Termination of Access: We reserve the right to terminate your access to the EV chargers at any time and for any reason without prior notice.

11. Modification of Terms: We may modify these Terms and Conditions at any time. The updated terms will be posted on our website, and it is your responsibility to review them periodically.

12. Governing Law: These Terms and Conditions are governed by the laws of the state of Victoria, Australia. Users must comply with all applicable laws and regulations while using the EV chargers.

By using the EV chargers, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
